Week one: Thursday, 8th of April 2010 (PLANNING WEEK)

I was given the general short form of contract booklet by Eng. Nor Zaidi bin Abdul Majib, which is issued by the international federation of consulting Engineers (FIDIC)* which include the general agreements conditions, rules for adjudication and notes for guidance for civil works. He also gave me a report for a real project of TNB which apply the short form conditions with some modification in order to suit the company rules and ability to finish the project. It also contains the bill of quantities and all civil works specifications that are involved in the project which are:
1.Site clearing
2.Earth works
3.Concrete works
4.Steel works
That project was done by FASTPRO SDN BHD at Cyberjaya north PMU Putrajaya central, and involves ducts, manholes and cables installation for 11KV and LV systems.
I spent the day reading the general short form booklet and comparing it with the applied rules by TNB. It was useful for me as it showed me many rules of contract that I was not aware of them.
E.g. of some modifications:
In section 10 of the general short form of contract which involve the variation and claims, subpart 10.4 involves the “right to claim” policy, is stated as bellow:
“If the contractor incurs cost as a result of any of the employer’s Liabilities, the contractor shall be entitled to the amount of such Cost. If as a result of any of the Employer’s Liabilities, it is necessary to change the works, this shall be dealt with as a variation”
The modification is as below:
“Add “except for the cost incurred from rectifying any loss or damage to contractor’s Equipment” at the end of the 1st sentence”
*Note:
1.FIDIC, is the French acronym for “International Federation of Consulting Engineers”.
2.The Short Form of Contract first edition 1999 can be obtained from website http://www.fidic.org or from the office of Association of Consulting Engineers of Malaysia (ACEM).
